Ordinance 866-2026

AN ORDINANCE TO AMEND “THE LAWS OF UNION COUNTY: ADMINISTRATIVE CODE AND POLICIES AND GENERAL LEGISLATION” BY AMENDING PART II- POLICIES AND GENERAL LEGISLATION: CHAPTER 115, SAFETY CODE, ARTICLE VI, DISORDERLY CONDUCT, AND CHAPTER 140, CONTRACTED OFF-DUTY EMPLOYMENT OF LAW ENFORCEMENT OFFICERS.

BE IT ORDAINED by the Union County Board of County Commissioners that the “Laws of Union County” are hereby amended, to reflect the designated deletions and corrections, or to be set forth in full as follows (those sections not listed are unchanged):

E.   Public Urination and Defecation.

It shall be unlawful to urinate or defecate in a public place owned or controlled by the County of Union, other than a bathroom or toilet room, under circumstances where such act is or could be observed by any other person.  The term “public place”, shall mean: “any area generally visible to the public view and includes but is not limited to streets, paths, dog parks, bodies of water or waterways, sidewalks, bridges, alleys, plazas, parks, driveways, parking lots, automobiles, buildings open to the public and doorways and entrances to buildings or dwellings, and the land and grounds surrounding same.”  A violation of this subsection shall, upon conviction, result in a fine of not less than two hundred and fifty dollars ($250.00) nor more than five hundred dollars ($500.00).     

Chapter 140, CONTRACTED OFF-DUTY EMPLOYMENT OF LAW ENFORCEMENT OFFICERS

§ 140-1. OFF-DUTY WORK BY LAW ENFORCEMENT OFFICERS 

The County establishes the following policy and procedures relating to the performance 

of services by off-duty law enforcement officers.

4. For services performed on County property or otherwise requested directly through the County, except as noted below, officers shall be paid, at a rate of $85.00 per hour. Any job that requires more than 4 officers shall include an assigned Officer in Charge, who shall be paid at a supervisory rate of $95.00 per hour.   For services performed pursuant to an Union County Film Permit, as required in conformity with Code §50-5(B.)(1), officers shall be paid, at a rate of $100.00 per hour  and supervisory officers shall be paid, at a rate of $110.00 per hour. Payment to officers for such work shall be made through the County’s payroll process in accordance with its regular practices. No officer shall be paid directly by any applicant.

7. County vehicles shall not be used during the performance of off-duty police-related services unless authorized by the Director of Public Safety, the Union County Sheriff, or their designees. The County shall impose a vehicle use fee of $150.00 per day or portion thereof, for a patrol vehicle and $200.00 per day or portion thereof for an ambulance.

AND, BE IT FURTHER ORDAINED, in case any section, subsection, paragraph, subdivision, clause or provision of this ordinance shall be judged invalid by a court of competent jurisdiction, such order or judgment shall not affect or invalidate the remainder of any section, paragraph, subdivision, clause or provision of this ordinance, and to this end, the provisions of each section, paragraph, subdivision, clause or provision of this ordinance are hereby declared to be severable;AND, BE IT FURTHER ORDAINED, that each section of this ordinance shall take effect at the time and in the manner provided by law, unless otherwise indicated.
