 In addition to oral comments presented during the hearing, written comments may be submitted to the agencies listed below.  All written comments must be received within two weeks following the hearing of December 14, 2021.

The purpose of this meeting is to inform the public of the County’s application to the New Jersey Department of Environmental Protection, Green Acre Program to sell a 0.243 acre portion of its parkland that is located in the Berkeley Heights section of the County’s Passaic River Park.  

This property is identified on the Berkeley Heights tax map as Block 201, part of Lot 2.   Specifically, the land in question is a portion of the former McClellan Street, a paper street vacated by the Township of Berkeley Heights in 1966.

The County wishes to sell this parkland due to a dispute over its ownership.  The application to vacate this street had been brought by Millmaster, whose property bordered McClellan Street on its northern side.  But when the Township approved Millmaster’s application, it did not clarify who was the owner of the vacated land.  Thus the County, as the owner of the property on the southern side of the vacated street, has a claim on this land as well.  The current owner of the Millmaster property, Chevron U.S.A. Inc., disputes the County’s claim. 

The appraised value of this unbuildable quarter acre of land is $60,237; which is the amount Chevron U.S.A. Inc. has agreed to pay the County.

Pursuant to State Law, the proceeds from this sale will be turned over to the Garden State Preservation Trust Fund.

Special Meeting of the Union County Utilities Authority

NOTICE OF THE UNION COUNTY UTILITIES AUTHORITY FOR THE SCHEDULING OF A SPECIAL MEETING IN ACCORDANCE WITH THE PROVISIONS OF THE NEW JERSEY OPEN PUBLIC MEETINGS ACT, N.J.S.A. 10:4-6 et seq.,

PLEASE TAKE NOTICE THAT:

A Special Meeting of the Board of Commissioners of the Union County Utilities Authority (the “Authority”) has been scheduled for Wednesday August 4, 2021, at 12:00 Noon, and shall held via Zoom’s virtual meeting online platform administered by way of the Authority’s administrative offices located at 1499 Routes 1 and 9 North, Rahway, New Jersey, 07065.  This notice is given pursuant to the “Open Public Meetings Act,” N.J.S.A. 10:4-6 et seq.

The Authority intends to discuss and formally consider the following during the meeting:

  1. Resolution recommending Administrative Action Plan Amendment to Union County District Solid Waste Management Plan clarifying operational components of Linden Renewable Energy LLC’s proposed Class C Recycling Facility to be located at 4900 Tremley Point Road, Linden, New Jersey

Portions of the meeting may be held in Executive Session. The public is hereby informed that prior, or subsequent, to completion of any Executive Session discussion, official action may be taken with respect to these matters during the public portion of the meeting.

The Authority’s meeting will be open to the public by electronic means and will be conducted through a videoconference via ZOOM. All members of the public may view the meeting by clicking the meeting link on the Authority website.  www.ucua.org.

Official Public Hearing on the 2021 Budget

Notice is hereby given that the Budget and Tax Resolution was approved by the County Commissioners of the County of Union on March 25, 2021. In light of the public health emergency caused by Coronavirus, and the subsequent issuance of ensuing Governor’s Executive Orders, the Board of County Commissioners of the County of Union (the Board), has been conducting meetings remotely and by electronic means without providing a physical meeting place and as such, the hearing on the Budget and Tax Resolution will be held remotely and by electronic means without providing a physical meeting place on April 22, 2021 at 5:30 PM at which time and place objections to the Budget and Tax Resolution for the year 2021 may be presented by taxpayers or other interested persons.

In accordance with N.J.S.A. 10:4-6 (the “Open Public Meetings Act”) and in adherence to the Department of Community Affairs, Division of Local Government Services (DLGS) guidelines, the public hearing on the 2021 Union County Budget and Tax Resolution will be open to the public by electronic means, and as such, will conduct the public hearing through a teleconference via ZOOM Webinar. Special Meeting of the Fiscal Affairs Committee

Under the terms of the “Open Public Meetings Act P.L. 1975, C. 231, please be advised that the Union County Board of County Commissioners will be holding a Special Meeting of the Fiscal Affairs Committee on Thursday, March 18, 2021 at 5:30 p.m. for the purposes of discussing the 2021 Budget.  These meetings of the Fiscal Affairs Committee are not Regular Meetings of the Board of County Commissioners. No action will be taken. 

While open to the public, there is no opportunity for public comment.  The time and place for public comments on the 2021 Budget are designated to take place during the official Public Hearing on the 2021 Budget, which will be announced at time of the budget introduction in accordance with the law.

In adherence to the Department of Community Affairs, Division of Local Government Services (DLGS) guidelines, this Union County Board of County Commissioners Special Meeting of the Fiscal Affairs Committee will be open to the public by electronic means, and as such, will be conducted through a teleconference via ZOOM Webinar. Union County, New Jersey awarded $297,764 in federal funds through the Department of Homeland Security (DHS), under the emergency food and shelter program (EFSP) phase 38.

Public Notice from the United Way of Greater Union County

Union County, New Jersey awarded $297,764 in federal funds through the department of Homeland Security (DHS), under the emergency food and shelter program (EFSP) phase 38.

The selection was made by a National Board that is chaired by the U. S. Department of Homeland Security’s Federal Emergency Management Agency. The Union County Local Board is charged to distribute funds appropriated by Congress to help expand the capacity of food and shelter programs in high-need areas around the country.

Notice is hereby given to all interested parties that the Union County Local EFSP Board will accept applications from local agencies and/or organizations for funding in the categories of (1) emergency other food, (2) mass shelter, (3) served meals, and (4) rent/mortgage assistance.

Please note: EFSP funding is only for eligible organizations, not for individuals or families.  This is not FEMA funding for disaster relief.

The Union County Local Board will review applications and determine how funds will be distributed.    

Under the terms of the grant from the National Board, local agencies chosen to receive funds must: 1) be private voluntary non-profits or units of government, 2) be eligible to receive Federal funds, 3) have an accounting system, 4) practice nondiscrimination, 5) have demonstrated the capability to deliver emergency food and/or  shelter programs, and 6) if they are a private voluntary organization, have a voluntary board.  Qualifying agencies are urged to apply.

  • Late or incomplete applications will not be considered.

Appeals

  • Applicants not selected for participation may appeal, provided it is based upon Board violations of program regulations only. No appeals will be heard based on award level.

  • Appeals will be made to the Local Board or a Committee of Local Board members. A written outcome will be provided within 10 business days.

Public Notice – Union County Reorganization

Under the terms of the “Open Public Meetings Act” P.L.., 1975, C. 231, the 2021 Installation Ceremony and Reorganization Meeting of the Union County Board of County Commissioners, formerly the Union County Board of Chosen Freeholders, will be held on Sunday January 3, 2021, at 12:00 p.m., at the steps of the Union County Courthouse (Courthouse Plaza) located at the Union County Courthouse, 2 Broad Street, Elizabeth, New Jersey. 

While open to the public, the installation ceremonies will be broadcast via Facebook live on the County of Union’s official website (www.ucnj.org) and the County of Union’s official Facebook page.  Upon conclusion of the Installation Ceremony and the election of a Chairman and Vice Chair of the County Commissioners, the Board will recess and reconvene indoors to conduct the business portion of the reorganizational meeting virtually through teleconference via Zoom Webinar.

Public Notice – Amendment to the Union County District Solid Waste Management Plan

PLEASE TAKE NOTICE that a Public Hearing will be held by the Union County Board of Chosen Freeholders on October 1, 2020, at 5:30 p.m., in accordance with N.J.S.A. 10:4-6 (the “Open Public Meetings Act”) and in adherence to the guidelines of the Department of Community Affairs, Division of Local Government Services for the purpose of hearing persons interested in, or who are affected by, the adoption of an Amendment to the Union County District Solid Waste Management Plan described below. 

An additional Public Hearing will be held by the Union County Board of Chosen Freeholders for the same purpose as set for above on October 1, 2020, at 1:00 PM.

Both Public Hearings will be open to the public by electronic means, and as such, will be conducted through a teleconference via ZOOM Webinar. THE PURPOSE OF THIS PLAN AMENDMENT IS TO AMEND THE UNION COUNTY DISTRICT SOLID WASTE MANAGEMENT PLAN BY INCLUDING A CLASS “C” RECYCLING FACILITY TO BE OWNED AND OPERATED BY LINDEN RENEWABLE ENERGY, LLC LOCATED AT 4900 TREMLEY POINT, LOT 8.02, BLOCK 587, LINDEN, NEW JERSEY TO ACCEPT 1,400 TONS PER DAY ON AVERAGE OF LIQUID ORGANIC FOOD WASTE DERIVED SUBSTRATE THAT IS PROCESSED BY THIRD-PARTIES OFF-SITE IN SATELLITE DE-PACKAGING FACILITIES OR OTHER ORGANIC FOOD WASTE  AND WILL UTILIZE ANAEROBIC DIGESTION TO CREATE RENEWABLE NATURAL GAS, AND A  MARKETABLE SOIL AMENDMENT.

Ingress and egress to the facility will utilize the following public streets:

  • Tremley Point Road, Linden

Hours of Operation for the proposed facility:

  •  24 hours per day, 7 days per week

Public Notice – County Of Union – Substantial Amendment To The Fiscal Year 2019 Consolidated Plan

The County of Union will be amending the Fiscal Year 2019 Consolidated Plan for the following program:

Emergency Solutions Grant (ESG) $3,739,745

PROPOSED USE OF FUNDS

The Emergency Solutions Grant (ESG) will provide: emergency shelter nights with case management supports to stabilize program participants; street outreach as a bridge to linking consumers with the Continuum of Care system for homelessness services; Homeless Management Information System (HMIS) to provide staffing for HMIS data entry; and tenant based rental assistance in order to obtain housing and/or retain it.  The funds under this program are intended to target two (2) populations of persons facing housing instability:

  1. Individuals and families who are currently in housing but are at risk of becoming homeless and need temporary rent or utility assistance or assistance to move to another unit (prevention), and
  2. Individuals and families who are experiencing homelessness (residing in emergency or transitional shelters or on the street) and need temporary assistance in order to obtain housing and retain it (rapid re-housing).

On March 27th, 2020, President Trump signed the Coronavirus Aid, Relief, and Economic Security (CARES) Act to help the Nation respond to the coronavirus outbreak.  The CARES Act made available an additional $4 Billion in Emergency Solutions Grant – CARES Act (ESG-CV) funds to supplement the Fiscal Year (FY) 2020 ESG funding provided under the Further Consolidated Appropriations Act, 2020 (Public Law 116-94).

Of this amount, the U.S. Department of Housing and Urban Development (HUD) immediately allocated $1 Billion for ESG-CV grants based on the FY2020 ESG formula. The rest of the funding for ESG-CV grants will be allocated directly to States or units of local government by a separate formula developed by the HUD Secretary.

Union County was awarded ESG-CV program funds and HUD has allocated $3,359,923 as authorized by the CARES Act, Public Law 116-136.  These special ESG-CV funds are to be used to prevent, prepare for, and respond to the coronavirus pandemic (COVID-19) among individuals and families who are homeless or receiving homeless assistance; and to support additional homeless assistance and homelessness prevention activities to mitigate the impacts of COVID-19.

Given the immediate needs faced by our communities, HUD has announced the first and second allocations of funds, which are subject to the following flexibilities and conditions provided by the CARES Act:

  • The funds may be used to cover or reimburse allowable costs incurred by a State or locality before the award of funding (including prior to the signing of the CARES Act) to prevent, prepare for, and respond to COVID-19;
  • The funds are not subject to the spending cap on emergency shelter and outreach under 24 CFR 576.100(b)(1);
  • Up to 10 percent of funds may be used for administrative costs, as opposed to 7.5 percent as provided by 24 CFR 576.108(a);
  • The funds are exempt from the ESG match requirements, including 24 CFR 576.201;
  • The funds are not subject to the consultation and citizen participation requirements that otherwise apply to ESG. However, each recipient must publish how its allocation has and will be used, at a minimum, on the Internet at the appropriate Government web site or through other electronic media;
  • The funds may be used to provide homelessness prevention assistance (as authorized under 24 CFR 576.103 or subsequent HUD notices) to any individual or family who does not have income higher than HUD’s Very Low-Income Limit for the area and meets the criteria in paragraphs (1)(ii) and (1)(iii) of the “at risk of homelessness” definition in 24 CFR 576.3;
  • That recipients may deviate from applicable procurement standards when using these funds to procure goods and services to prevent, prepare for, and respond to COVID-19, notwithstanding 24 CFR 576.407(f) and 2 CFR 200.317-200.326;
  • Individuals and families experiencing homelessness must not be required to receive treatment or perform any other prerequisite activities as a condition for receiving shelter, housing, or other services for which these funds are used, notwithstanding 24 CFR 576.401(e).

In addition, the CARES Act authorizes the HUD Secretary to grant waivers of and specify alternative requirements for statutes and regulations the HUD Secretary administers in connection with the use of ESG funds (except for requirements related to fair housing, nondiscrimination, labor standards, and the environment).  These waivers and alternative requirements can be issued when necessary to expedite and facilitate the use of funds to prevent, prepare for, and respond to coronavirus.

The overall funding in the amount of $3,739,745, which includes the $379,822 in annual ESG and the $3,359,923 in ESG-CV.  These funds will be utilized and allocated as listed below:

  1. Emergency Shelter (Operations & Essential Services): $1,177,881
  2. Street Outreach: $47,022
  3. Homeless Management Information System (HMIS): $27,339
  4. Rapid Re-Housing-Housing Relocation & Stabilization Services: $191,172
  5. Rapid Re-Housing-Tenant-Based Rental Assistance: $697,673
  6. Homelessness Prevention-Housing Relocation & Stabilization Services: $297,320
  7. Homelessness Prevention-Tenant-Based Rental Assistance: $1,189,279
  8. Administration: $81,036

ESG-CV funds are not subject to the consultation and citizen participation requirements that otherwise apply to the ESG funds for Substantial Amendments.
